Terms of Service

These Terms of Service ("Terms") govern access to and use of the Grow Business IQ Marketing OS platform ("Service") provided by Saber IQ LLC ("Saber IQ", "we"). By creating an account or using the Service, you agree to these Terms.

1. SaaS Agreement

Saber IQ grants you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes during your subscription term.

2. Subscription & Billing

Paid plans are billed monthly or annually in advance in U.S. dollars via our payment processor. Subscriptions renew automatically until cancelled. Cancellation takes effect at the end of the current billing period.

3. Refund Policy

Monthly plans are non-refundable. Annual plans may be refunded on a pro-rated basis within 14 days of the initial charge. Requests: billing@growbusinessiq.com.

4. AI Disclaimer

The Service uses AI models to generate content, recommendations, and automations. Output may be inaccurate, incomplete, or unsuitable. You are responsible for reviewing and approving any AI-generated material before publishing or acting on it. Saber IQ makes no warranty regarding AI output.

5. Acceptable Use

You may not:

• use the Service to violate any law or third-party right;
• publish deceptive, hateful, harassing, or infringing content;
• attempt to reverse engineer, resell, or circumvent access controls;
• upload malware or interfere with the Service's operation;
• violate the terms of any connected platform (Meta, Google, LinkedIn, TikTok, YouTube).

6. Intellectual Property

Saber IQ owns the Service, including software, models we develop, and branding. You retain ownership of the content and business data you submit. You grant Saber IQ a limited license to process that content solely to deliver the Service.

7. Third-Party Platforms

The Service integrates with third-party APIs. Your use of those platforms is governed by their own terms. Saber IQ is not responsible for their availability or changes.

8. Limitation of Liability

To the maximum extent permitted by law, Saber IQ's total liability for any claim arising from the Service will not exceed the fees you paid in the 12 months preceding the claim. Saber IQ is not liable for indirect, incidental, or consequential damages, including lost profits, revenue, or data.

9. Termination

You may terminate at any time from account settings. We may suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your right to use the Service ends and your data will be deleted per the Data Deletion policy.

10. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of laws principles. Exclusive venue for any dispute lies in the state or federal courts located in Galveston County, Texas.

11. Changes

We may update these Terms. Material changes will be announced at least 14 days before taking effect.
